NEWS FROM OSTROLENK, FABER, GERB & SOFFEN, LLP
April 2004
Peter S. Sloane successfully represented Novartis International Pharmaceutical, Ltd. in an opposition against an application to register the trademark
DERMAVIR for "vaccines and vaccine adjuvants" filed by Genetic
Immunity, LLC. Novartis is the owner of the mark DENAVIR as used and
registered for "antivirals" and "preparations for the treatment of cold
sores and related skin disorders." In upholding the opposition, the
Trademark Trial and Appeal Board found that Novartis had demonstrated
priority and a likelihood of confusion between the marks. If you would
like to receive a copy of the decision, please contact Peter Sloane at psloane@ostrolenk.com.
Charles P. LaPolla and Mary Fontenot secured the entry of a Consent Judgement on behalf of Six Flags in a suit for trademark infringement against a hotel in Oklahoma City
using the name FRONTIER CITY INN. The Defendant must change the name of
its hotel to another name not incorporating the term FRONTIER because
of Six Flag's ownership of the trademark FRONTIER CITY for an amusement
park located in Oklahoma City.
