Marc Lieberstein, Partner, along with Douglas A. Miro, Partner, Martin Beran, Of Counsel, Mary Fontenot and Anthony Lovensheimer,
Associates, obtained a Temporary Restraining Order for an Ostrolenk,
Faber client against multiple defendants who used the name, image and
likeness of President Ronald Reagan on select coins and medal products
without authorization and in violation of our client's exclusive rights
under the Right of Publicity and Federal Unfair Competition laws. We
obtained the Temporary Restraining Order three (3) days after we
learned of the unauthorized use. Ultimately, we secured favorable
settlements and licenses with each of the defendants within ten days of
the entry of the Temporary Restraining Order.
Peter S. Sloane successfully represented Honeywell International
Inc. in a domain name dispute filed against Domain Deluxe to obtain
transfer of the domain names honyewell.com and homeywell.com. In Honeywell International Inc. v. Domain Deluxe , FA0405000269166, filed with the National Arbitration Forum, the Panel
held that Respondent's domain names were confusingly similar to
Complainant's HONEYWELL mark, that Respondent did not have any rights
or legitimate interests in the domain names, and that Respondent had
registered and used the domain names in bad faith. If you would like a

Miro, Partner, presented a lecture entitled "Patent Claim Writing" at the Practising Law Institute's program Fundamental of Patent Prosecution: A Boot Camp for Claim Drafting & Amendment Writing in New York City which was held June 23 25, 2004. On June 7, 2004 Martin Beran,
Of Counsel, delivered a presentation to the Trademark Committee of the
New York State Bar Association entitled "The Eighth Commandment: Thou
Shalt Not Steal Ð Another's Trademark or Trade Dress." Mr. Beran
reviewed several trademark and trade dress cases from the 1960's
through the present using a combination of anecdotes and actual samples

Peter Sloane's article "Preventing the Unauthorized Importation of Altered Gray Market Goods: Practical Suggestions for U.S. Trademark Owners" was published in the June 2004 issue of Intellectual Property & Technology Journal.
A copy of the article is attached hereto. In the article, he reviews a
number of important gray goods cases to help U.S. trademark owners spot
existing differences between their genuine product and any unauthorized
product and to develop new methods to differentiate the authorized from
